Terms of Service
1. Who we are
Pharez Menu is a managed digital and QR menu service operated by Pharez Printing & Advertising PLC (“Pharez”, “we”), Addis Ababa, Ethiopia. These terms govern the Client’s use of the Pharez Menu service, the online dashboard and the public menu pages we host for the Client. Each Client also signs a short service agreement that states the package, price and term.
2. The service
- We build and host a digital menu for the Client, reachable by QR code and web link, and provide an owner dashboard for editing dishes, prices, photos, translations and availability.
- The package (Digital Only, Print + Digital, or other) is set out in the service agreement. Features outside the package are not included.
- We aim for the menu to be available at all times but do not guarantee uninterrupted service. Planned maintenance and third-party outages (hosting, internet, database provider) can cause short interruptions.
3. Accounts and access
- The Client names its owner and team members. Roles are Owner, Manager and Staff; staff can only mark items sold out.
- The Client is responsible for keeping passwords private and for everything done under its accounts. Tell us promptly if an account is compromised or a team member leaves.
4. Client content and responsibility
- The Client owns its menu text, prices, photos, logos and other content and gives Pharez a licence to host, display, translate-format and back up that content only to run the service.
- The Client is responsible for the accuracy of dishes, prices, ingredients and allergen information, and for confirming allergen questions with guests directly. The menu is an information aid, not a substitute for the kitchen’s own allergen controls.
- The Client confirms it has the right to use all content it uploads, and will not upload unlawful, misleading or infringing material. We may remove such content.
- Translations that Pharez or the Client’s team add should be reviewed by the Client for accuracy before going live.
5. Fees and payment
- Fees are stated in Ethiopian Birr (ETB) in the service agreement or on our packages page. Unless stated otherwise, prices are per year and exclude VAT, which is added where required by law.
- Fees are payable in advance for the term. We will issue a fiscal receipt or invoice for each payment.
- If payment is overdue by more than 14 days after written notice, we may suspend editing access. If it is overdue by more than 30 days, we may take the public menu offline until payment is made.
6. Term, renewal and cancellation
- The term and renewal date are set in the service agreement. We will remind the Client before renewal.
- Either party may end the agreement with 30 days’ written notice (email or WhatsApp counts as written notice). Prepaid fees for unused full months are refunded unless the service agreement says otherwise, except for printed materials already produced.
- We may suspend or end the service immediately for serious misuse, unlawful content or non-payment as described above.
- On request after the term ends, we will give the Client an export of its menu content and remove it from our systems within 90 days, except where we must keep records by law.
7. Printed materials
QR table cards, printed menus and other physical items are produced by Pharez Printing & Advertising PLC to the specification approved by the Client in writing. The Client should check proofs carefully; reprints needed because of an approved error are charged to the Client. A QR code printed for the Client keeps working for as long as the service is active.
8. Intellectual property
Pharez keeps all rights in the Pharez Menu software, dashboard, templates and branding. The Client may not copy, resell or reverse-engineer them. The menu design layouts we create for the Client may be used by the Client only while it is a customer, unless the agreement says otherwise.
9. Guests’ data
How we handle data is explained in our Privacy Policy. The Client agrees to use any guest data we make available (for example, menu view statistics) only for its own business and in line with Ethiopian law.
10. Limits of liability
- We provide the service with reasonable care. To the extent the law allows, we are not liable for indirect or consequential loss, lost sales or lost profit.
- Our total liability to a Client for any claim is limited to the fees the Client paid for the 12 months before the claim arose.
- Nothing in these terms limits liability that cannot lawfully be limited.
11. Changes to these terms
We may update these terms. We will tell Clients about material changes at least 30 days before they apply. Continued use after that date means acceptance.
12. Governing law and disputes
These terms are governed by the laws of the Federal Democratic Republic of Ethiopia. We will first try to resolve any dispute by talking to each other. If that fails, the courts of Addis Ababa have jurisdiction.
